The court canceled construction plan of Kaş district
The court decided to cancel the construction plan which was prepared by metropolitan municipality of Antalya to envision about 40 thousand population for Kaş. The case was seen at Antalya 4th Administrative Court and 31 people with the Natural Life Protection Foundation involved in. The expert report prepared by Dokuz Eylül University faculty members Prof. Dr. Çınar Atay, Prof. Dr. Sibel Ecemiş Sword and Prof. Dr. Emine İpek Uzbek at the request of the court stated that the 1/25 thousand reconstruction plan prepared by the Antalya Metropolitan Municipality for the town of Kaş does not comply with the spatial plan decisions and is incompatible with many forest areas and special environmental decisions.
FORECASTING 38 THOUSAND POPULATION WITH PLAN
It was noted that the plan, which was planned with a population of 38.200 inhabitants, would cause damage to the natural environment in the region by using natural environment and archeological protection areas, as a tourism facility area in the turtle nesting area. In the expert report it was stated that the plan was not in conformity with urbanism principles, public interest, development legislation and planning techniques.
IRREPARABLE DAMAGE CAUSES
Having regard to the expert report, the Court has reached the conclusion that the plan is not in conformity with the principles of urbanism, principles of planning and public interest. Since the lawfulness of the case against which the court had previously decided to stop the execution was clear, the reconstruction plan is canceled, as compensation might be incurred if it were applied.
